MedsClaim Terms of Service

Effective date: October 25, 2026

These Terms of Service ("Terms") are an agreement between you and MedsClaim, the operator of medsclaim.com ("MedsClaim," "we," "us"). They cover your use of the MedsClaim website, apps, and services, including any MedsClaim experience offered to you through a healthcare provider, telehealth company, employer, or other partner (together, the "Services").

Please read Section 18 carefully. It requires most disputes to be resolved by individual arbitration, not in court or as a class action. You can opt out within 30 days of accepting these Terms.

You accept these Terms by checking the box or clicking "Agree" when you create an account. If you don't agree, don't use the Services.

1. What MedsClaim does

MedsClaim helps you get reimbursed for eligible health expenses from your flexible spending account (FSA), health savings account (HSA), health reimbursement arrangement (HRA), or similar benefit account ("Benefit Account"). Depending on the features you turn on, we can:

  • find receipts and expense confirmations in accounts you connect, such as your email;
  • tell you when an expense may be eligible;
  • help you get a Letter of Medical Necessity (LMN) from a licensed clinician when one is needed;
  • assemble claim packages with receipts and provider details;
  • submit claims for you, when you authorize it (Section 3); and
  • estimate how much you may save based on information you give us.

2. What MedsClaim is not

  • We are not your benefit administrator, health plan, or insurer. Your plan administrator decides whether a claim is approved and how much you get back. We don't control that decision.
  • We do not give medical, tax, legal, or financial advice. Eligibility flags, savings estimates, and other suggestions are informational only. Ask a qualified professional about your situation.
  • We do not provide medical care. An LMN is written only by a licensed clinician using their own professional judgment. A clinician may decline to write one.
  • We are not a party to your relationship with any partner (such as your telehealth provider or employer). Their own terms and privacy notices also apply to what you do with them.

3. Your authorization for us to act for you

When you turn on claim submission, you appoint MedsClaim as your limited agent to:

  • prepare, sign as your authorized representative where the administrator allows, and submit claims to your Benefit Account administrator;
  • send supporting documents, such as receipts and LMNs, with those claims; and
  • receive status updates and requests for more information about those claims.

This authorization is limited to the claims you approve, or to the claims covered by the auto-submit rules you set. It does not let us withdraw, transfer, or spend money from any account, change your benefit elections, or act for you in any other matter.

You can revoke this authorization at any time in your account settings. Revoking it stops future submissions. It does not cancel claims already submitted.

4. Your responsibilities for claims

Each time a claim is submitted, by you or by us on your behalf, you confirm that, to the best of your knowledge:

  • the expense was actually incurred by you, your spouse, or a dependent eligible under your plan;
  • the expense is eligible under your plan and applicable law (for example, IRS Publication 502);
  • the expense has not been reimbursed, and will not be reimbursed, from another source; and
  • the information and documents are accurate and unaltered.

You are responsible for keeping the records your plan or the IRS requires, and for any taxes, penalties, or repayments that result from an ineligible reimbursement. MedsClaim lets you download your claim records at any time.

If we learn that a claim we submitted contains an error we caused, we will tell you and help you correct it with your administrator.

5. Connected accounts

You can connect accounts, such as an email inbox, pharmacy, retailer, or benefit account ("Connected Accounts"), so we can find and retrieve your records. By connecting an account, you:

  • confirm you are allowed to connect it and to let us access it;
  • authorize us to access it, and to retrieve records from it, only as needed to provide the Services you've turned on; and
  • understand that the provider's own terms still apply, and that a provider may limit, change, or block access at any time.

We use secure, token-based connections where the provider offers them. When we must store a login, we encrypt it and use it only to retrieve your records. You can disconnect any account at any time. When you do, we delete its stored login or token.

We are not responsible for the services, availability, or actions of Connected Account providers.

6. Information about other people

If you submit expenses or information for a spouse, dependent, or anyone else, you confirm that you have the right to do so and, where required, their permission.

7. Eligibility and your account

  • You must be at least 18 and live in the United States to create an account.
  • Give accurate information and keep it up to date.
  • Keep your login secure and turn on multi-factor authentication when we offer it. Tell us right away at support@medsclaim.com if you think someone else has accessed your account.
  • One person per account. Don't share or transfer your account.

8. Fees

[CHOOSE ONE MODEL AND DELETE THE OTHERS]

  • [Option A: Free to you.] The Services are free to you. They are paid for by [your healthcare provider / employer / partner]. We will never charge you without first getting your clear consent to a paid plan.
  • [Option B: Subscription.] The Services cost [PRICE] per [month/year]. Your subscription renews automatically until you cancel. We'll show you the price and renewal terms before you subscribe, and email you a reminder before each annual renewal. You can cancel online at any time in your account settings. Cancellation takes effect at the end of the current billing period. [REFUND POLICY.]
  • [Option C: Success fee.] We charge [PERCENT]% of each reimbursement you receive for a claim we submit, and only when the reimbursement is paid. You'll see the fee before you approve each claim, or before you turn on auto-submit.

If we change our fees, we'll give you at least 30 days' notice by email. The change won't apply to you until you accept it. Payments are processed by [PAYMENT PROCESSOR]. We don't store your full card number.

9. Acceptable use

Don't:

  • submit claims you know are false, inflated, duplicated, or ineligible;
  • use the Services to access accounts or information that aren't yours;
  • interfere with, overload, or probe the security of the Services;
  • copy, resell, or reverse-engineer the Services, except where the law allows it; or
  • use the Services in violation of any law.

We may suspend or close accounts that do these things (Section 15).

10. Your content

You own the documents and information you give us or let us retrieve ("Your Content"). You give us a limited license to use Your Content only to provide, secure, and support the Services for you, and as described in our Privacy Policy. We don't sell Your Content. We don't use your health information for advertising.

If you send us feedback or ideas, we may use them without owing you anything.

11. Our property

The Services, including our software, design, and brand, belong to MedsClaim and its licensors. We give you a personal, non-transferable, revocable right to use the Services under these Terms. We keep all other rights.

12. Privacy

Our Privacy Policy and Consumer Health Data Privacy Policy explain how we collect, use, and protect your information. If you use MedsClaim through a healthcare provider or health plan, some of your information may also be protected by HIPAA and handled as described in that organization's Notice of Privacy Practices.

13. Communications

You agree to receive notices, disclosures, and agreements from us electronically, by email or in the Services. These satisfy any legal requirement that they be in writing. You can ask for a paper copy at support@medsclaim.com.

We'll only send you text messages if you separately opt in. Message and data rates may apply. Reply STOP to opt out, or HELP for help.

14. Changes

To the Services. We may add, change, or remove features. If we remove a feature you pay for, we'll give you a prorated refund for the unused period.

To these Terms. For material changes, we'll email you and post a notice in the Services at least 30 days before the change takes effect. If you keep using the Services after that, the new Terms apply. If you don't agree, you can close your account before the change takes effect. Changes won't apply to disputes you've already told us about.

15. Ending your account

By you. You can close your account at any time in settings or by emailing support@medsclaim.com.

By us. We may suspend or close your account if you seriously or repeatedly break these Terms, if we must for legal reasons, or if we stop offering the Services. Unless the law or a security risk prevents it, we'll give you notice and the reason.

What happens next:

  • Claims already submitted stay with your administrator. We'll pass along any status updates we receive for 30 days.
  • You'll have at least 30 days to download your claim records.
  • We'll delete your information as described in our Privacy Policy.
  • Sections 4, 10 (feedback), 11, 16, 17, 18, and 19 continue to apply.

16. Disclaimers

We work hard to make MedsClaim accurate and reliable, but we can't guarantee that every expense will be found, that every eligibility flag is correct, that any claim will be approved, or that the Services will be uninterrupted. To the extent the law allows, the Services are provided "as is" and "as available," and we disclaim implied warranties of merchantability, fitness for a particular purpose, and non-infringement. Some states don't allow these disclaimers, so they may not apply to you.

17. Limits on liability

To the extent the law allows:

  • we are not liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits; and
  • our total liability for all claims relating to the Services is limited to the greater of (a) the fees you paid us in the 12 months before the claim arose and (b) $100.

These limits don't apply to liability for our gross negligence, willful misconduct, or fraud, or to anything else the law doesn't allow us to limit.

You agree to cover our reasonable costs, including attorneys' fees, from third-party claims caused by your knowing submission of a false or fraudulent claim, your misuse of someone else's information, or your violation of law.

18. Disputes and arbitration

18.1 Talk to us first. Before starting arbitration or a lawsuit, email support@medsclaim.com with your name, contact information, a description of the dispute, and what you want. We'll do the same. Both sides agree to try in good faith to resolve it within 60 days.

18.2 Arbitration. If we can't resolve it, you and MedsClaim agree to resolve any dispute relating to the Services or these Terms by binding individual arbitration, administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules. The Federal Arbitration Act governs this section.

  • Fees. We'll pay all AAA filing, administration, and arbitrator fees beyond what you'd pay to file in court. Each side pays its own attorneys' fees unless the arbitrator awards them under applicable law.
  • Location. The arbitration will take place by video, by phone, or in the county where you live, as you choose.
  • Mass filings. If 25 or more similar arbitration demands are filed by the same or coordinated counsel, they will be administered under the AAA's Mass Arbitration Supplementary Rules.

18.3 Exceptions. Either side can bring an individual claim in small claims court, and either side can ask a court to stop infringement or misuse of intellectual property.

18.4 No class actions. Claims may be brought only individually, not as a plaintiff or class member in a class, collective, or representative proceeding. If this class-action waiver is found unenforceable for a claim, that claim will be decided in court, not in arbitration.

18.5 Opting out. You can opt out of this arbitration agreement by emailing support@medsclaim.com within 30 days of first accepting these Terms. Include your name, account email, and a statement that you opt out. Opting out won't affect anything else in these Terms.

18.6 Courts. Any dispute not subject to arbitration will be decided in the state or federal courts in [COUNTY, STATE], unless the law of your state of residence gives you the right to sue where you live.

19. General

  • Governing law. The laws of [STATE] govern these Terms, apart from conflict-of-law rules and except where federal law applies.
  • Entire agreement. These Terms, our Privacy Policy, and our Consumer Health Data Privacy Policy are the whole agreement between us about the Services. If you use MedsClaim through a partner, nothing in your agreement with that partner changes these Terms.
  • Severability. If any part of these Terms is unenforceable, the rest stays in effect.
  • No waiver. Not enforcing a right now doesn't mean we give it up.
  • Assignment. You can't transfer these Terms. We may transfer them in a merger, acquisition, or sale of assets, and we'll tell you if we do.
  • Events outside our control. We're not responsible for delays caused by events we can't reasonably control, including outages at Connected Account providers or benefit administrators.

California users. Under California Civil Code §1789.3, you may contact the Complaint Assistance Unit of the Division of Consumer Services of the California Department of Consumer Affairs in writing at 1625 North Market Blvd., Suite N 112, Sacramento, CA 95834, or by phone at (800) 952-5210.
